These Terms of Service ("Terms") are an agreement between you and AgTap LLC ("AgTap," "we," "us"), the maker of the AgTap family of farm-operations applications and the agtap.com website (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you don't agree, don't use the Service.
AgTap is a record-keeping and coordination tool for farm operations — irrigation tracking, field maps, tasks, equipment records, and related features. It is built by farmers and tested on real farms, but it is a tool, not a substitute for your judgment:
You must be at least 18 years old to create an account. You agree to provide accurate information, keep your password secure, and accept responsibility for activity under your account. Crew members you invite through share links or crew links act under your account's umbrella — choose who you share with carefully.
You own your farm data. Field boundaries, watering records, equipment logs, notes, photos, documents, and everything else you put into AgTap belongs to you. You grant us only the limited license needed to operate the Service — storing your data, displaying it back to you and the people you share it with, and processing it through the service providers that make the app run.
AgTap lets you create share links (field plans, locations, live watering views, QR asset tags). Anyone who has a share link can view what it contains — no AgTap account required. You are responsible for who you send links to. Links expire on the schedule shown in the app, and you can revoke them at any time from the Shared Links panel.
The Service is currently offered free of charge while we grow. We may introduce paid plans in the future; if we do, pricing will be presented clearly before you are charged, billing will recur on the cycle you select (monthly or annually), and you may cancel at any time, effective at the end of the current billing period. We may change prices with advance notice. Continued use after a price change takes effect constitutes agreement to the new price.
Optional integrations (such as connecting a John Deere Operations Center account) are governed by the third party's own terms as well as these Terms. You can disconnect an integration at any time in the app. We are not responsible for third-party services or the accuracy of data they provide.
You agree not to:
We may suspend or terminate your account and access to the Service immediately, without prior notice or liability, at our sole discretion, for any reason — including breach of these Terms or use of the Service (including free trials) to probe or copy it. You may stop using the Service and request account deletion at any time. Sections that by their nature should survive termination (data ownership, disclaimers, liability limits, dispute resolution) survive.
The Service — its software, design, and original content (excluding your farm data) — is the exclusive property of AgTap LLC and is protected by copyright, trademark, and other laws. The AgTap name and logo may not be used without our prior written consent.
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that data will never be lost — keep your own backups of anything critical.
To the fullest extent permitted by law, AgTap LLC and its members, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, crop loss, equipment damage, or business interruption — arising from your use of or inability to use the Service. Our total liability for any claim will not exceed the greater of $100 or the amount you paid us in the twelve months before the claim arose.
Before filing any claim, you agree to contact us at help@agtap.com and give us 30 days to work the issue out informally.
These Terms are governed by the laws of the State of Arkansas, without regard to conflict-of-law principles.
We may update these Terms from time to time. If a change is material, we will give notice in the app or by email at least 15 days before it takes effect. Continued use of the Service after the effective date constitutes acceptance.
